Terms of Service

Welcome to ChapterKeep. These Terms of Service ("Terms") govern your use of the ChapterKeep web application and services. By creating an account or using ChapterKeep, you agree to these Terms.

1. Acceptance of Terms

By accessing or using ChapterKeep, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use ChapterKeep.

2. Account Registration

• You must be at least 13 years old to create an account
• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activity that occurs under your account
• You must notify us immediately of any unauthorised use of your account

3. Subscriptions and Payments

3.1 Free Plan

ChapterKeep offers a free plan with limited features. The free plan may be subject to usage limits as described on our pricing page.

3.2 Pro Plan

The Pro plan provides access to additional features for a recurring subscription fee. Subscription fees are billed in advance on a monthly or annual basis.

3.3 Free Trials

We may offer free trial periods for the Pro plan. At the end of the trial, your subscription will automatically begin unless you cancel before the trial ends.

3.4 Cancellation and Refunds

• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of the current billing period
• No partial refunds are provided for unused portions of a billing period
• Upon cancellation, you retain access to Pro features until the end of your paid period
• After your paid period ends, your account reverts to the Free plan

4. Acceptable Use

You agree not to:

• Use ChapterKeep for any unlawful purpose or in violation of these Terms
• Post content that is abusive, harassing, threatening, or discriminatory
• Impersonate any person or entity or misrepresent your affiliation
• Upload viruses, malware, or other harmful code
• Attempt to gain unauthorised access to other accounts or systems
• Use automated means to scrape, crawl, or extract data from ChapterKeep
• Interfere with or disrupt the integrity or performance of ChapterKeep
• Post spam, advertising, or solicitations in the community forum

5. User Content

5.1 Your Content

You retain ownership of content you create on ChapterKeep (reviews, notes, quotes, forum posts). By posting content, you grant ChapterKeep a non-exclusive, worldwide, royalty-free licence to display that content within the service.

5.2 Content Moderation

We reserve the right to remove content that violates these Terms or is otherwise objectionable. We may suspend or terminate accounts that repeatedly violate our content policies.

6. Intellectual Property

ChapterKeep, including its design, features, code, and branding, is owned by ChapterKeep and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on ChapterKeep without our prior written consent.

7. Third-Party Services

ChapterKeep may integrate with or link to third-party services. We are not responsible for the content, practices, or availability of third-party services. Your use of third-party services is at your own risk and subject to their terms.

8. Disclaimer of Warranties

ChapterKeep is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, ChapterKeep shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, regardless of the cause of action.

10. Indemnification

You agree to indemnify and hold harmless ChapterKeep and its officers, employees, and agents from any claims, damages, or expenses arising from your use of ChapterKeep or violation of these Terms.

11. Termination

We may suspend or terminate your access to ChapterKeep at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use ChapterKeep ceases immediately.

12. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes through the application or by email. Your continued use of ChapterKeep after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms shall be resolved through good-faith negotiation or, if necessary, through binding arbitration.
